What is a 1031 Exchange?

Section 1031 of the U.S. Internal Revenue Code www.irs.gov allows investors to defer capital gains taxes on the exchange of like-kind properties.

In a typical transaction when an investment property is sold, the seller must pay a capital gains tax on the total gain/sales proceeds. However under Section 1031 of the Internal Revenue Code the tax requirement can be deferred if the seller invests the total amount of the gain into one or more replacement properties of "like-kind”.

What happens when I sell my exchange property? Will I have to pay a tax then?

As long as you continue to reinvest the money in a "like kind" Property" you can defer your taxes. If you do not re-invest the gain in a “like kind Property” you will pay taxes on the total of the deferred gains.

Is there another alternative to buying replacement property? What if I am tired of managing properties?

If you just want to sit back and collect a return on your investment without dealing with the every day management of owning investment properties, then a TIC investment is for you.

Under TIC owner ship, you own an undivided portion of a large commercial property. You will own along with a number of other investors, however you will receive a separate deed and title insurance for your percentage interest in the property. There is typically anywhere from 1-35 investors for each TIC property.


How do I make money with TIC ownership?

There are a few different types of investment strategies under TIC ownership. Depending on which strategy you use you will receive a cash on cash return of anywhere from fixed rate of 6% to variable rates of %13%.

Are there lot's of TIC companies out there?

Tic ownership is becoming increasingly popular. Many companies are starting to come together to offer these types of products, but beware, not all TIC companies are the same. You want to make sure you get involved with a TIC company that has a history of success.
